1. Who we are and who these terms are for

Tune-Up Sites is a service of CK eCom UG (haftungsbeschränkt), Germany ("we"; full details in our imprint). These terms apply to every subscription to Tune-Up Sites. We offer the service only to businesses, not to consumers.

2. What you get

We build a website for your business from the content you already publish or send us, host it and keep it online with a secure connection. We publish the website as shown in the version you approved. You can change the text and photos of your website yourself in the editor we provide. Changes to the layout, additional sections and other work beyond that are not included in the price; we quote them before we start.

3. No ranking guarantee

We do not promise any position in Google, ChatGPT or any other search engine or AI assistant. Their results depend on factors we do not control.

4. Price and payment

The price is USD 29 per month or USD 290 per year, as shown when you subscribe. Payment is made in advance by card through our payment provider. We may change prices for future billing periods with at least 30 days' notice by email. Prices do not include any taxes you may owe locally.

5. Term and cancellation

The monthly plan renews every month and can be cancelled at any time by email; it ends at the end of the month already paid. The yearly plan is paid upfront for twelve months and renews for another year unless cancelled before the renewal date. If you cancel a yearly plan, it stays active until the end of the paid year; we do not refund unused months.

6. Late or failed payment

If a payment fails, we will tell you by email and try again. If the amount is still unpaid 14 days after that email, we may take the website offline until it is paid. A failed payment does not cancel the subscription.

7. Your content, our software, your domain

Your texts, photos, logo and business details remain yours. You confirm that you have the rights to the content you publish or send us, and you allow us to use it to build and run your website. The design templates and code we use to build the site remain ours; while you subscribe, you may use them for your website. Your domain stays registered in your name; you point it to our servers.

8. When the subscription ends

We take the website offline at the end of the last paid period. If you ask within 30 days after that, we send you a free static copy of the site (its HTML pages and images) that you can host elsewhere.

9. Accuracy of your content

You are responsible for the accuracy of the information on your website, including information we took from your previous site. Tell us when something needs correcting. We may refuse to publish content that is unlawful or misleading.

10. Support

Support is by email at ec@tuneupsites.com. We usually answer within two business days.

11. Availability

We aim to keep your website online at all times but cannot guarantee uninterrupted availability. Maintenance and outages of our hosting provider can cause short interruptions.

12. Liability

We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for breach of essential obligations and limited to the damage typical and foreseeable for this kind of contract, in total no more than the fees you paid in the twelve months before the damage occurred.

13. Changes to these terms

We will tell you about changes to these terms by email at least 30 days before they take effect. If you do not agree, you can cancel before that date.

14. Law and venue

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Hanover, Germany.
